Il Giudice dispone il sequestro  di tutti gli esemplari riproducenti illegittimamente le borse della collezione Book Tote di Dior, nonché di qualsiasi altra borsa recante le medesime fantasie, decorazioni e motivi grafici utilizzati per le collezioni delle Book Tote e/o la medesima banda multistrato  che si trovino a qualsiasi titolo nella disponibilità di Piccole Emozioni srl presso i suoi locali in: Viareggio (LU), Via Cesare Battisti 122, cap. 55049; • Luni (SP), Via Larga 31, cap. 19034. Visti gli artt. 131 c.p.i., 163 l.a., 2599 c.c., 614-bis e 700 c.p.c. dispone a carico di Piccole Emozioni srl l’inibitoria della produzione, commercializzazione, acquisto, importazione, esportazione, detenzione e/o pubblicizzazione, anche a mezzo internet e social network, di tutti gli esemplari di borsa sopraindicati. Fissa, ai sensi dell’art. 131 co. 2 c.p.i., 163 l.a., 2599 c.c., 614-bis e 700 c.p.c., una somma non inferiore a € 500,00 a titolo di penale per ogni singolo articolo trattato dalla resistente in violazione dell’inibitoria di cui sopra a far data dal giorno successivo a quello della comunicazione del presente provvedimento.
